General terms and conditions
These are the General Terms and Conditions of Halsduk by Esmee, a Dutch brand of EMH Styling, a sole proprietorship incorporated under the laws of the Netherlands. EMH Styling is located at Koestraat 19, 5688 AG in Oirschot, the Netherlands. E-mail: firstname.lastname@example.org. Telephone: +31 6 5158574. These terms and conditions apply to all purchase and sales agreements entered into by EMH Styling and its customers via the website of Halsduk by Esmee (EMH Styling). By ticking the box “I agree with the conditions” you agree with the content and their applicability to the agreement you enter into with EMH Styling.
Purchases on the website
You can place an order with EMH Styling by clicking on all the desired items on the website, which will place the products in your ‘shopping bag’. You can check your items in the ‘shopping bag’ and make the necessary changes. As soon as the ‘shopping bag’ matches your wishes, you can click on the order button. This then generates an electronic order form stating the desired items. Upon completion of the order form including payment details, you can click on, Continue and you will be redirected to a secure environment to complete the financial transaction. This will complete your order. After your order has been processed, EMH Styling will in principle send you an e-mail confirming receipt, if a product is out of stock you will be contacted as soon as possible after which the amount will be returned. EMH Styling reserves the right to refuse a transaction process for any reason and/or services to anyone at any time at its sole discretion.
Pricing and website information
The prices shown on the website include VAT. The total price mentioned on the order and on the order form includes shipping costs. Within the Benelux no shipping costs will be charged. Any and all customs or import duties and/or local taxes are for the account of the customer. The above mentioned costs are not included in the price. Prices are subject to change at any time. Changes in prices do not affect the amount payable in a concluded sales contract as confirmed by EMH Styling by e-mail. Although all information relating to prices, specifications etc. is posted on the website with the greatest possible care, EMH Styling does not guarantee its accuracy. EMH Styling is not bound to issue all orders placed on the basis of incorrect information displayed on the website.
Payment can be made by creditcard, Ideal or by cashing in the Sustainable Fashion Giftcard (only valid in The Netherlands). EMH Styling is affiliated with Mollie payments. By using a certain creditcard (number) you confirm that the creditcard used is yours. The amount due will be debited from your account when your order has been accepted by EMH Styling. All creditcard holders are subject to verification and validation authorization by the credit card company. If the issuer of your payment card refuses to allow a payment to EMH Styling, we will postpone delivery and contact you. In that case, EMH Styling shall not be liable for any delay or non-delivery.
EMH Styling will do its utmost to deliver all purchases within the confirmed delivery time. EMH Styling shall not be liable if delivery takes place at a later time. EMH Styling shall be entitled to deliver the order up to thirty days after the order has been placed without being held in default by the customer. If the deadline is exceeded, the customer shall receive written confirmation. The customer may then cancel the contract free of charge. The customer shall then receive a refund of the amount paid as soon as possible, but no later than thirty days after termination.
Deliveries take place via Post NL. If you are not at home or you have missed the delivery person, the Post NL-delivery person will leave a message stating that you can pick up the parcel at one of the post offices in your area.
All items are insured by EMH Styling until they are delivered to your address. Any complaints about the condition in which the goods have been delivered (including missing parts) must be made to EMH Styling no later than two working days after receipt of the goods by e-mail or telephone. (See details on page 1) You can track your package using the Track & Trace code that you received from EMH Styling by e-mail.
All goods purchased from EMH Styling can be returned up to fourteen working days after delivery. Cancellation must automatically result in the dissolution of the purchase agreement between EMH Styling and the customer, whereby the customer is obliged to return the goods to EMH Styling within four working days of receipt of the goods. Goods returned outside the specified period may be returned to the purchaser without refund. All accurately returned products will be credited within 30 days as a refund to the creditworthiness of the original purchaser or to the bank account, excluding any shipping costs to the delivery address. The costs of the return shipment will be borne by the buyer. In order to receive a refund, the product you are returning must be in new unused and unworn condition and in its original packaging, labels still attached and including the bag provided. New and unused means no stains on the item and bag and no wear and tear on the labels and bag. Unused also means: no damage to the item and bag.

The liability towards the buyer shall be limited to the amount of the purchase price. EMH Styling shall never be liable for any loss of profit or goodwill or any other consequential loss.
Applicable law and forum
The laws of the Netherlands shall apply. Any dispute relating to a purchase and sales agreement to which these terms and conditions apply shall be submitted exclusively to the District Court in ‘s-Hertogenbosch, unless EMH Styling chooses to bring this dispute before the competent court in the purchasers’ place of residence.
